DIGGI GAMES TERMS OF USE

These Diggi Games® terms of use (“Terms of Use”) set forth certain supplemental terms and conditions that apply to your play of the Georgia Lottery (the “Lottery”) Diggi Games® that are made available via the Georgia Lottery Website (the “Website”) and the Georgia Lottery’s mobile application (“Mobile Application” and collectively with the Website, the “Sites”). Additionally, we may post these Terms of Use with any other application or software authorized by us to access and/or display Diggi Games® from time to time, in which case the subject application or software shall also be considered a “Site” for purposes hereof. Your play of Diggi Games® is also subject to all rules, terms and conditions, privacy policies, disclaimers and agreements on the Lottery Sites ("General Terms"). Additionally, each individual Diggi Game® is subject to the game-specific procedures (the "Game Procedures”) provided by the Lottery with the Game which are incorporated herein by this reference and constitute an integral part of these Terms of Use. The Lottery reserves the right to make changes to these Terms of Use, including the Game Procedures, at any time without advance notice to you, and such changes will be effective immediately upon posting.

BY PLAYING DIGGI GAMES®, YOU ACCEPT AND AGREE TO COMPLY WITH THE TERMS OF USE, THE GENERAL TERMS AND APPLICABLE GAME PROCEDURES. IF YOU DO NOT AGREE, DO NOT ACCESS OR PLAY DIGGI GAMES®. THE RIGHT TO PLAY DIGGI GAMES® IS PERSONAL TO YOU AND IS NOT TRANSFERABLE TO ANY OTHER PERSON OR ENTITY.

1. LICENSE GRANT

You are granted a revocable, non-exclusive, non-transferable, non-sublicensable, limited license to access and play Diggi Games® solely for your personal entertainment and non-commercial use. The Lottery reserves the right to discontinue any or all Diggi Games® at any time in its discretion without notice to you, to offer different Diggi Games® on the different Sites and to remove any or all such Diggi Games® from the Sites and terminate your access thereto. Any and all rights not expressly granted to you are hereby reserved by the Lottery on behalf of itself and its suppliers.

2. ACCESS

Diggi Games® are only available for purchase on the Sites to authorized users physically located within the State of Georgia and otherwise in compliance with the General Terms, including those terms applicable to the use of Geo-location Software. Diggi Games® may not be purchased at retail. In order to play Diggi Games®, you must log into your Players Club iHOPE® Account, certify your location and allow us to verify your location within the State of Georgia as contemplated in the General Terms. You are solely responsible for obtaining and maintaining any and all equipment and connectivity necessary to access the Sites and play the Diggi Games®. Diggi Games® may not be available on certain devices due to operating requirements associated with Diggi Games®. The Lottery makes no representations or warranties as to your ability to access and play Diggi Games®, or that the Sites or Diggi Games® will display correctly on all devices on which they can be viewed.

3. LIMITATIONS

The Lottery may, at its discretion, impose limits on the number of times Diggi Games® may be played over a defined time period. Other limitations applicable to Diggi Games® may be imposed by the Lottery from time to time in its discretion. Notice of limits imposed by the Lottery will be provided to you in an appropriate manner to be determined by the Lottery.

4. GAME PROCEDURES AND OPTIONS

Information specific to each Diggi Game® is indicated on the applicable Site. This information includes a general description of the Game, price per play and maximum single cash prize available. Each Game includes HOW TO PLAY and GAME PROCEDURES & ODDS tabs providing additional Game-specific information, including a description of Game features and play style, prize structure, approximate odds of winning any prize and method of determining outcomes of play.

Interested Diggi Game® players may have the option to "Buy Now" or "Try Now." By design, the Game play and player experience are the same, although there are important differences. By choosing "Buy Now," the player elects to purchase the Game, and the purchase value will be deducted from the player's iHOPE® Account. Once confirmed, Game purchases cannot be voided or cancelled. All sales are final. If a Diggi Game® player chooses "Try Now," the player acknowledges that he or she is playing a trial version of the Game; the player is not purchasing a play, and the player will not be awarded a cash or other prize even though the Game results may reveal a prize.

Under no circumstances will the Lottery or any of our suppliers have any liability or responsibility whatsoever with respect to tickets, shares or plays produced, programmed, communicated, rendered, displayed or issued in error, including as a result of any programming or communication error, and/or not in compliance with these Terms of Use and the General Terms. Without limiting the generality of the foregoing, no prize shall be paid arising from claimed tickets, shares or plays produced, programmed, communicated, rendered, displayed or issued in error, or that are counterfeit, altered, fraudulent, incapable of validation or authentication or the result of any security breach, including circumvention of applicable security safeguards.

5. COMMON GAME FEATURES

Diggi Games® are games of chance, and the outcome of a play in the case of any Diggi Game® is pre-determined by the interactive system at the point of purchase and is not affected by the skill, judgment or action of the player. The Lottery’s interactive system distributes plays based on the probabilities within the prize structure and not from a limited pool or range of plays. The overall chances of winning in a Diggi Game® at each prize level are determined by the prize structure. Prizes, including top prizes, are subject to availability at the time of purchase. Accordingly, the Lottery intends to update and disclose the actual contemporaneous overall odds of winning from time to time on the Sites as it determines appropriate. Additionally, the Lottery reserves the absolute right to take any action it deems appropriate or desirable to extend or continue any Diggi Game, including the right to supplement and/or replenish the prizes for a Game, utilizing the same prize structure, at any time in its discretion. Players will have 1 hour from the time of purchase to complete a Diggi Game. If a play for a Diggi Game® is not completed within the time allotted for any reason, including the interruption of the player, loss of connectivity during game play or Game termination by the Lottery, the play will be played out to completion automatically by the Lottery’s system on your behalf to reveal the pre-determined outcome. The Lottery will notify players of such outcome. The Lottery may notify you of a pending unfinished Game. A Diggi Game® is considered complete when its outcome status indicates whether or not a prize has been won.

Diggi Game® cash prizes will be paid out in accordance with the rules, policies and procedures included in the General Terms.

The Lottery makes no representations or warranties with respect to Diggi Games® or the operation of any Diggi Game, the Sites or its interactive system, including any representation that any such operation will be error-free. If the system fails to deliver the Diggi Game® following a player's payment for such Diggi Game® play, the purchase value of the play will be credited back to the player's iHOPE® Account as soon as practical following reconciliation and such credit shall be the player's sole remedy.

6. TERMINATION

In addition to its rights under the General Terms, as noted above, the Lottery may discontinue one or more Diggi Games® at any time in its discretion without notice to you and to remove any such Games from any or all Sites and terminate your access thereto. Any pending unfinished Game terminated by the Lottery will be played out to completion automatically by the system on your behalf to reveal the pre-determined outcome.

7. CERTIFICATION REGARDING PURCHASE FROM WITHIN THE STATE OF GEORGIA

Diggi Games® are only available for purchase by authorized users while located within the State of Georgia. To confirm purchase of a Diggi Game, the player must be within the borders of the State of Georgia. Further, by requesting a Game, you give the Lottery permission to verify your location through the use of geo-filtering software and/or other location identification services, tools and software available through the Sites. If we are unable to verify your physical location within the State of Georgia for any reason, you will not be able to play Diggi Games®. Neither access to, nor the availability of, Diggi Games® constitutes an offer from the Lottery or its suppliers to you to purchase Diggi Games® if you are located outside of the State of Georgia.

8. GENERAL TERMS

All General Terms of the Site apply to Diggi Games® and are hereby incorporated. In the event of any direct conflict among the display of the Game results, applicable Game Procedures, these Terms of Use, the General Terms and any other information issued by the Lottery with respect to Diggi Games® or the applicable Game, these Terms of Use will prevail as to Diggi Games®.
